Terms and Conditions

1. Services

Digixfly Digital Marketing ("Digixfly," "we," "us") provides search engine optimization (SEO), pay-per-click advertising management, and related digital marketing services as described in individual client agreements. These terms apply to all visitors and clients of digixfly.com.

2. No Guaranteed Rankings

Search engine algorithms are controlled by third parties (Google, Bing, and others). While we employ proven strategies and have a strong track record of results, we cannot and do not guarantee specific rankings, positions, or traffic volumes. Our 60-day satisfaction guarantee covers measurable improvement in visibility and lead generation. If no improvement is seen within 60 days of implementation, we continue working at no charge until results materialize. This guarantee applies to visibility and lead metrics, not specific ranking positions.

3. Payment Terms

Services are billed monthly in advance unless otherwise agreed in writing. All fees are quoted in US dollars. Payment is due upon receipt of invoice. Late payments may result in suspension of services. All fees are non-refundable except as expressly stated in a signed service agreement.

4. Month-to-Month Terms

All engagements are month-to-month unless a specific term is agreed to in writing. Either party may cancel with 30 days written notice. No long-term contracts are required. No cancellation fees apply.

5. Client Responsibilities

To perform our services effectively, clients agree to:

• Provide timely access to website analytics, hosting, and relevant platforms.
• Respond to requests for information, approvals, or materials within a reasonable timeframe.
• Ensure that any content, images, or materials provided to us do not infringe on third-party intellectual property rights.

6. Intellectual Property

All content, strategies, reports, and deliverables created by Digixfly remain our intellectual property until full payment is received. Upon full payment, clients own the deliverables created specifically for them. Digixfly retains the right to use anonymized performance data and results in case studies, marketing materials, and portfolio presentations unless otherwise agreed in writing.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the engagement. This includes business data, strategies, client lists, and financial information. This obligation survives termination of the agreement.

8. Limitation of Liability

Digixfly's liability for any claim arising from our services is limited to the fees paid by the client for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages, including lost profits or business interruption.

9. Website Use

By using digixfly.com, you agree not to:

• Copy, reproduce, or redistribute our content without permission.
• Use our website for any unlawful purpose.
• Attempt to gain unauthorized access to our systems.

10. Changes to Terms

We may update these terms from time to time. Clients will be notified of material changes. Continued use of our services after changes constitutes acceptance of the updated terms.
